East Coast O Scalers will be meeting at their annual convention. Convention Details:

The Convention dates are June 18th through June 20th, 2009. Convention organizers have talked to many of the vendors and attendees at various O scale shows across the country and have constructed this convention based on the input they received.

The convention will be held at Towson University, 8000 York Road, Baltimore, Maryland, 21204. The O scale Convention will have exclusive use of the Student Union Building providing a spacious venue for vendor tables, displays, clinics, dining, and informal chats.

Kadee is known worldwide for their high quality replacement couplers. They also manufacture ready to run (RTR) and kit freight cars and accessories in several scales including HO scale and N scale. Kadee’s latest offerings are announced in the FREE March 2009 flyer here.

Kadee continues their popular Sam the Answer Man column. 2009 March flyer has installment #29:

“New Products & Accucraft AMS Conversion”
This series is to help answer the many questions about Kadee® products and to provide “Helpful Hints” to modelers using our products. This month we are announcing the first official release of our kit cars, yes I said “KIT”. These are our 40 and 50 foot PS-1 box cars in an unpainted undecorated kit form. Painting and decaling (decals not included) are left up to the modeler. The kits are #4100 a 40 foot box car, #4105 a 50 foot with 9 foot door, #4110 a 50 foot with double door, and #4115 a 50 foot with the H-40 cushion underframe. They assemble “without” glue or adhesives of any kind. Every part is either friction or press fit, hooks, or snaps in place just like our RTR cars. See our web site at www.kadee.com for more information. Also, we are releasing our Whisker® #146 long centerset standard shank coupler in the continuing #148 series of couplers. Last month we released the medium underset #147 Whisker® coupler.
I recently finish a coupler conversion on an Accucraft AMS (American Model Supply) On30 box car from their 3000 series. Generally speaking, this is a very nice
model with very nice detail work on the body. However, I thought the trucks could have be done better. There are two issues concerning the couplers. First their
knuckle coupler is the absolutely worst I have ever seen. It’s a sort of an imitation of our #803 On3 coupler. It’s interesting that they’d even thought that any modeler
could ever use such a bad coupler. The centering and knuckle springs are so stiff that you have to use a hammer and a pry bar to get them to couple up. The trip pin
is at the HO coupler length for an On3 coupler and isn’t even ferrous metal to be magnetically uncoupled, although the spring stiffness prevents this anyway.
The best point of this is their coupler mounting platform. They were actually thinking ahead on this feature. They have provided two coupler mounting heights,
one for the common HO coupler height and one for the On3 coupler height. There is a spacer block for our standard HO #5 coupler and by removing the spacer the
platform is now near the correct On3 coupler mounting height for our #803. Since Bachmann made their popular On30 models with HO scale couplers and other
factory and scratch built On30 models use the On3 size of couplers, AMS has accommodated both those who wish to or have to use HO scale couplers and those
that wish to use the On3 couplers. So we recommend using our #5 coupler at the HO coupler height or our #803 black and #807 brown at the On3 coupler height.
Fortunately, our #5 and #803/807 (and S scale #802) draft gear boxes use the same screw hole pattern so there is no needed alterations or drilling and tapping
new holes. Also if the coupler heights are a bit off it’s rather easy to add shim washers (#208 and #209) between the truck and body to raise the coupler height or
a thin shim under the draft gear box to lower the coupler. Use our #205 or #206 HO coupler height gauge or our #815 On30 coupler height gauge with a #803 On3
coupler.

  • N SD-35 Locomotives
  • Atlas describes the SD-35 as “Between 1964 and 1966, EMD built a total of 360 six-axle 2,500hp SD35 locomotives. An additional 35 steam generator-equipped SDP35 locomotives were also built during this period. These were all part of EMD’s “35-Series” which also featured the four-axle, 2,250hp GP35 locomotive. All locomotives included the standard EMD 567-series prime mover. A stock model weighed 360,000 pounds, but many roads chose to add weight to increase the locomotive’s tractive effort. From the mid-1960s through the 1980s, the SD-35 could be found in road service on both large and mid-sized roads across the US. Today the number of active units has dwindled to a select few, including those operated by regional railroad Montana Rail Link.”

  • Atlas reports: “This release of the C420 is a low-nose “phase 2” model. All Phase 2 versions will feature the low/vertical mounted engine air intake located ahead of the radiator area on the long hood. Early phase 2 locomotives feature phase 1-style walkways/sills with stanchions mounted into the top walkway deck (referred to as “Phase 2a” models). Later phase 2 locomotives feature a revised configuration where the stanchions are mounted to the sides of the sill (referred to as “Phase 2b” models). Phase 2a production ran from December 1964 through September 1965. Phase 2b units were produced from December 1965 through the end of C420 locomotive production in August 1968.”The Atlas Master™ Series Gold versions of these locomotives are able to use all of the QSI® Quantum System™ sound features on DC layouts with use of the Atlas Quantum Engineer™. News -  FREE Spring 2009 Catalog from Atlas Model Railroad Co.

Atlas Model Railroad Company has been busy this Spring of 2009. Atlas has recently issued their Atlas Spring 2009 Catalog. It is available for FREE download here. The catalog lists numerous products being released between April, 2009 and August, 2009 in N scale, HO scale, and O scale. Check this FREE catalog for new engines, railroad freight cars, accessories, and equipment in your favorite scale and road name.

These new and limited run products are being offered for pre-manufacture orders. Don’t wait for final release dates. Get your orders in now so that the Company knows how many of each item to produce.

Unlike most product manufacturers, model train manufacturers set the size of their production runs based largely on the number of pre-orders received months before release. If you don’t want to be disappointed later, you need to show your interest at this stage of the process. Otherwise Atlas, and most other model train companies, will either cancel the production of certain models and paint schemes or make fewer of them.

This keeps costs for modelers lower than if manufacturers took a greater risk (by not seeking pre-orders) and had many unsold trains that had to be paid for or financially justified by very small sales. On the other hand, if they didn’t take pre-orders, the manufacturer’s limited capital could be tied up in unsold inventory and other new products would have to wait even longer until the manufacturer has sold out all of the unwanted stock that their money was spent on.

This process is a little out of the ordinary (when compared to massive merchandising of a very few models of a product distributed through big box stores), but it creates more variety in a shorter cycle, at lower prices, for modelers from companies that are financially viable year after year in a small, specialized, yet quality and price sensitive market.

Lionel and M.T.H. have been engaged in a bitter lawsuit against each other. The O Scale manufacturing giants declared “peace” on December 31, 2008 and announced a joint licensing agreement.

The Official Press Release and company comments describe the accord as follows:

Yesterday, an electric charge rippled through the model train boards when someone managed to find a draft of a press release on the M.T.H. web site that was not otherwise available to the public, and post it on OGR. And while the timing was off by a week or so, the facts are correct.

Since the news leaked yesterday afternoon that Lionel is going to license M.T.H. to use its name on historical tinplate Standard and O Gauge model trains and accessories, a lot of questions have been raised, and I’ve heard everything from, “Wow, great for the hobby,” to “Wow, say it ain’t so.” I understand that the idea of Lionel and M.T.H. working cooperatively, so soon after settling our long and bitter lawsuit, is a shock to a lot of people, especially those who became so personally invested in that conflict.

I can only say that the model train hobby isn’t about lawsuits or personal enmity, it’s about exciting products, the fellowship of enjoying them, and ultimately, it’s about making sure that our hobby is stable and strong. I’m sure I can speak for Mike Wolf, when I say that the best way to repair the damage that was done to our hobby as a result of those hostilities is for our two companies to do exactly that.

Before anyone starts singing Kumbaya, or wondering what happens on the color spectrum when you mix Orange, Blue and Purple, I’d like to issue a reality check and answer some of those questions that were raised:

Lionel and M.T.H. are two, entirely separate companies with entirely different business models and destinies. We fiercely compete, and will continue to fiercely compete, in the core, O gauge segment of the model railroad hobby, especially in the arena of high-end engines and Operating Systems. However, our interests do not conflict, to any great extent, in other gauges and markets. Both companies are equally committed to making great trains and, where we do compete, both companies are equally committed to convincing hobbyists that they do so better than the other. And none of that will change.

The agreement between Lionel and M.T.H. is a conventional and straightforward, multi year license, in which Lionel will be paid a royalty on each tinplate train that is sold. As an acknowledged and acclaimed maker of tinplate trains and accessories, M.T.H will now be able to do so using the historical and authentic Lionel and American Flyer badging that made them historical and authentic in the first place. While M.T.H. will be solely responsible for manufacturing the new line, Lionel will work with M.T.H to select the trains that will be made over the next few years, and will do whatever it can to help make them the success they deserve to be.

Yesterday, before the thread that broke the news was taken down, in response to a post that expressed strong negative feelings, someone quoted the great, old Nick Lowe song, ‘What’s So Funny About Peace, Love, and Understanding?’ I can only add that we live on a very small planet and we participate in an even smaller hobby. And while I don’t anticipate that M.T.H. and Lionel will begin exchanging Valentine’s Day cards, it’s not too much to work on items one and three.

LIONEL LICENSES M.T.H. FOR TINPLATE

New York City, NY, Dec. 31, 2008 — Lionel Electric Trains announced today that it has entered into a multi-year licensing agreement with M.T.H. Electric Trains, in which the Columbia, MD, model train maker will create a new line of tinplate Lionel Standard and O gauge products. The license will also include tinplate Standard and O gauge offerings for American Flyer, which has been part of Lionel since its acquisition in 1967.

Using its extensive collection of tinplate tooling, M.T.H. plans to issue new versions of Lionel and American Flyer classic tinplate trains and accessories that were originally released between 1900 and 1942. These products will be packaged in all-new boxes with iconic Lionel and American Flyer advertising images and logos from the prewar tinplate era. Promotion of new tinplate Lionel and American Flyer products will begin in early 2009, with full-color catalogs. A Web site, dedicated to the new product line, will also offer product videos, sound clips and other information not available in print catalogs.

“I’m very pleased that M.T.H. and Lionel will be working together on this new Lionel and American Flyer tinplate line,” said Jerry Calabrese, Lionel CEO. Calabrese went on to say, “In times as difficult and challenging as these, I hope it’s reassuring to all model train fans that both our companies will be joining forces to write a productive new chapter in our hobby’s history. There is no better way to express our mutual belief and commitment to the future of model railroading than for Lionel and M.T.H. to collaborate on something as imaginative and exciting as these new Tinplate products.

“This collaboration builds on what we’ve accomplished with our Tinplate Traditions line over the past three decades,” noted M.T.H. President Mike Wolf. “It is no secret to those who know me that Lionel’s history has inspired me since my youth.” Wolf went on to say, “By working together, our two companies will be able to offer products that even more faithfully evoke the beauty and artistry of the toys that Lionel and American Flyer turned out in the prewar years, as well as make those trains available to a wider audience.

Wolf added, “Putting aside the differences our firms have had over the years, Jerry and I have always recognized how much synergy exists between Lionel and M.T.H. Together we sat down and worked out this agreement with the express goal of expanding on both firms’ longstanding commitments to grow our hobby.”

Based in New York City, Lionel has been making model trains and accessories since 1900. It is one of the world’s leading model train companies, and among the most widely recognized brands in America.

January, 2009 LGB has issued an expanded (48 page) new items brochure listing new scale model railroad trains for release in 2009 following American prototypes. The catalog in German AND English is available for FREE download at http://medienpdb.maerklin.de/pdf/lgb_neuheitenkat.pdf
Maerklin has taken over LGB and is still in transition. Walthers is their North American distributor. The full catalog of LGB products is scheduled for release in fall of 2009.

Maerklin/LGB says:

We apologize that there are no new molds for American models this year. We still have preparatory work to do but we will be able to produce your requests for LGB models in the future. Nevertheless, this year’s new items do reflect a clear policy. All the new LGB products in the North American range this year are variations that have not been produced before in that way or they are reissues with new car numbers.  These were both requests made to us by many LGB fans. … We regularly postfurther information on our web site at www.lgb-bahn.de.

FREE - Model Railroad Magazine

FREE - Model Railroad Magazine

January 2009 Model Railroad Hobbyist magazine was launched. It is available FREE online at http://model-railroad-hobbyist.com/. The FREE magazine is a mix of high quality articles and interviews of model railroading’s most knowledgeable and recognizable people, great photos and videos, and solid products and advice for modelers in all scales.

The magazine is delivered using a mix of high tech online presentation and glossy magazine style. It is totally free to the readers, due to paid advertising sponsorship. If you run into technical problems check the FAQ sections for known issues and ways to resolve them.

The first issue weighs in at 78 megabytes. The download takes quite a while. It requires the latest and greatest Adobe reader 9 software and a capable computer to run them. Anticipating model railroaders who will be anxious for the download to complete, it is also available in a somewhat slimmed down version.

The FAQ promises that some editions could be as large as 100 megabytes. It was more than my usually zippy internet connection delivers in one chunk. I admit I’ve been spoiled by much smaller individual web pages. I even lose patience when video feeds lag. I went out of the room and got a soft drink for me as my computer gulped up all that the network could deliver.

Model Railroad Hobbyist magazine is worth the wait. Once it was downloaded and running it delivered some interesting articles and ads I’m going to follow up on. It’s worth getting your own copy and reading. Subscribe to the magazine so you get a two week jump on web delivery of the next issue.

The magazine fills the screen and drops many of the familiar navigational tools and tabs in favor of a simplified interface and dash board supplied by the Adobe Reader software. Some of the articles expand on the glossy print magazine approach and reveal additional related photos and video inserts.

News - HO Scale, N & Z Scale - Model Train and Railroading Catalogs Released January 2009

You CAN make your 2009 model trains and railroading dreams comes true. Model railroad giant, Walthers has released its HO Scale and separate N and Z Scale 2009 Model Railroad Reference Book and Catalog.

These hefty catalogs filled with products and accessories for model railroading and trains are the stuff of dreams. They provide an illustrated guide to a wide range of offerings in your favorite scales - HO, N and Z. Walthers acts as a distributor for numerous manufacturers. These large catalogs give you a good feel for what is generally available right now from several sources. These catalogs are an investment and a valuable reference as you build your model railroad.

It would be impossible for one distributor to carry all the products from all the manufacturers in a given scale.  Some of the manufacturers release products in small quantities, and on there own schedules. Some manufacturers want direct relationships with retailers or customers and do not want to deal with any one or sometimes even any distributors.

Make sure to keep alert for product announcements. Press releases and products reviews can provide valuable resources. Regularly scan the internet, blogs, e-mail, and e-groups. Watch specialty magazines and newsletters for your favorite roadnames, scale, and manufacturers. Request catalogs and price sheets from those that do not publish on line. Don’t miss something special by looking at a single source only.

The Walthers catalog provides a good snapshot of the more popular and generally available products for the great middle of the marketplace. (More expensive, specialty, extra high quality, and limited runs seldom appear in the Walthers catalog.) Many related products and accessories are included. These large catalogs are an expensive item to produce. Walthers only issues one for each scale every few years. If you work in HO Scale, N Scale, or Z Scale this is a good time to get one. Walthers has recently become the North American distributor for LGB (G Scale) products. It’s highly likely that they will release a new separate large scale catalog in the next year or two to reflect that. I recommend that you subscribe to their e-newsletter or view their sales flier online to keep up to date.

Walthers catalog has to limit the products shown within their own range of offerings. It would be way too unwieldy to show every variation, accessory, update, and paint scheme. If you need something specific, check their web site, call local retail shops, and buy it now (it may not be there a few months from now). Walthers has supplemental e-mailings, and smaller newsletters or sales fliers. It continuously updates and expands its web site. Subscribe to the information sources that will help you build your dream railroad.

Model Railroads and Intellectual Property (Trademarks, Trade Dress & “Fair Use”)

Model railroad product manufacturers are being required to acknowledge, and occasionally pay licensing fees, for trademarks, paint schemes (trade dress), and designs by the big real-world railroad companies. Recent examples include the fourth quarter 2008 efforts of BNSF and the 2002 through 2005 efforts of Union Pacific.

January, 2009 editorial at Model Railroad News attacks the practice and describes it as

What BNSF is doing is not illegal, but it does have the joyful property of the biggest kid in school shaking down the kindergartners for their milk money.

I’m no expert on this situation, but I can see a reasonable middle ground. To a large extent, intellectual property like trademark, trade dress are intended to allow manufacturers to create a logo and color schemes that identifies where a product came from. Over time this logo and color schemes become closely identified with the company and products and is itself a valuable part of the business. Companies want to prevent their logos and colors from being used in an unauthorized way to protect their reputation and the meaning that the logo and colors have acquired over time (usually through great efforts in quality manufacturing and huge advertising expenses). A company may not want a piece of junk with their logo on it. They may not want something they have no connection with looking as if they had authorized or produced it.

I disagree with the editorial in some respects and agree with it in others. Just because model railroad companies are small is no excuse to break the rules. Just because following the law is inconvenient to some commercial enterprises as opposed to those who it is protecting in this instance, is no reason to break the rules.

The middle course is to have a licensing agreement with the model railroad companies that acknowledges the ownership of the trademarks, logos, and trade dress, color schemes. The model railroad manufacturers should get the license for NO FEES in exchange for the logo owner’s reasonable prior approval of its use. This would prevent competing companies from stealing or ruining the reputation of the trademarks, logos, trade dress, and color schemes. It would still allow the trade mark owning companies to stop unsavory uses of their logos. It would allow model railroad manufacturers to go forward without fear of expensive lawsuits or expensive fees for the licenses.

International and US Trademark law should be revised to include a provision similar to copyright law’s provision for “fair use” for limited educational, or non-profit personal use without a formal license agreement needed. Until such a change in the law is approved and put in force model railroad companies should refrain from producing products with active, enforceable trademarks (logos) and trade dress (color schemes) without a license. (By the way - if a trademark has fallen into the public domain then the model railroad manufacturers can use them freely.)

There is a prior case that creates an exception big enough to drive a train through. There is a famous case where a company that produced dog food wanted to use the “Cadillac” automobile logo on it’s dog food. The courts ruled that there was no way to confuse dog food with and automobile and it was OK to use the exact same logo and name as the luxury car on their cans of dog food. A similar argument could be raised. There is no way that a model railroad or model train could be confused with the transportation services and reputations of a full size train company or their equipment. Therefore all such uses of logos and color schemes for the entire field of model trains should be allowed with no licenses at all.
